§1 General Terms
These Regulations define the rules and functioning of the Online Store www.perillalingerie.com.
The owner of the Online Store registered at the internet address www.perillalingerie.com is:

The online store sells goods via the online store system registered at www.perillalingerie.com
The order is effective only after accepting these Regulations.
The Regulations are part of the contract between the Online Store and the Buyer pursuant to art. 384 of the Civil Code.
The Buyer / Consumer is a natural person, legal person or organizational unit that does not have legal personality, but has the legal capacity to make legal decisions in accordance with the law. The buyer must have an e-mail account.
The Buyer / Consumer is a natural person who purchases products in the Online Store in accordance with art. 221 of the Civil Code.
Legal entities other than Consumers do not comply with the Consumer Rights Act of May 30, 2014. The Online Store is not responsible for physical and legal defects in relation to persons and entities other than Consumers.
The information contained on the website of the Online Store constitutes an invitation to conclude a contract within the meaning of art. 71 of the Civil Code, but it is not a sale proposal within the meaning of Art. 66 of the Civil Code.
The Online Store presents digital photos of products on the website, emphasizing their high quality and how well they reflect the actual conditions and colors of the presented product.
The photos presented on the website are the intellectual property of the Online Store in accordance with the Copyright and Related Rights Act of February 4, 1994.
The prices presented on the website can be given in Polish currency (PLN), euro (EUR) or in US dollars (USD). In both cases, they are gross prices, which means that they already include the entire tax.
The Online Store reserves the right to change product prices, introduce new products, remove products that are no longer available, carry out and cancel promotions and make other changes.
Orders are accepted through the shop system at www.perilla.pl. When placing an order, please fill in the required fields correctly in accordance with the instructions.

It is possible to place an order for a non-standard size of the product on the website by sending an inquiry to the following e-mail address: firstname.lastname@example.org.
The Online Store reserves the right to refuse to make non-standard sizes of the product, if the technical and construction conditions of the product and the change in the price of the non-standard product do not allow it, as well as in the event of additional costs related to it. creating such a product.
The conclusion of a distance purchase / sale agreement between the Website / Online Store and the Buyer takes place upon the successful completion of the purchase process defined in the order form of the store system located at www.perillalingerie.com
The Online Store is obliged to provide the Buyer with brand new goods, free from technical and legal defects, legally released for trading. The Consumer's obligations end upon receipt of the item and payment of the amount due, in accordance with these Regulations, subject to the obligations incumbent on the Consumer in the event of a complaint or withdrawal from the contract.
In the event of unavailability of the ordered product, the Online Store is obliged to inform the Buyer about this fact within no more than 14 working days from placing the order. The buyer is responsible for deciding how to execute the remaining part of the order - partial execution, cancellation of the entire order and refund, extended waiting time for the order or replacement of the missing product with another product.
The proof of purchase is an e-mail confirming the purchase of the product at www.perillalingerie.com. Such e-mail is sent to the e-mail address provided by the Consumer when placing the order.
Payment can be made via PayPal, Shoplo, BlueMedia, COA and plastic money:

- Electronic MasterCard
The product is delivered in the manner chosen by the consumer. The products are delivered by a courier company selected by the Online Store. Products are shipped no later than 14 days from the date of receipt of payment or the Consumer's choice of COA.
International shipping costs are set individually via the shopping system at www.perillalingerie.com.
§3 Customer complaint
The online store is liable to the consumer if the sold item has a physical or legal defect (warranty).
The Online Store is exempt from liability under the warranty, if the Consumer knew about the product defect at the time of concluding the contract.
If the sold product has a defect, the Consumer may submit an experience to reduce the price or withdraw from the contract, unless the Online Store immediately replaces the defective product or removes the defect.
If the sold product has a defect, the Consumer has the right to demand that the item be replaced with a defect-free one.
The consumer cannot withdraw from the contract if the defect is irrelevant. If only some products from the order have defects, the consumer has the right to withdraw from the contract only for the defective items.
The consumer submitting a complaint should send via e-mail to the following e-mail address: email@example.com a complaint statement, proof of purchase and transfer details, and then return the purchased goods with the note COMPLAINTS to the following address:

The complaint should include: Product name with a short description, order number, Buyer's personal data (name, surname, address, telephone number, e-mail) with a detailed description of the physical defects of the product that requires replacement.
The Online Store is obliged to reimburse the Consumer for the costs related to the return of defective items immediately after processing and taking into account the Consumer's claims under the warranty for defects in items.
If it is not possible to repair or replace the purchased goods with a new one, the Online Store will inform the Consumer about the possibility of replacing the goods with another.
After receiving the parcel, the Consumer is obliged to check it in the presence of the deliverer and in the event of any mechanical damage caused during transport, to write a protocol signed by the Consumer and the deliverer.
Complaints are considered within 14 business days from the moment the goods are delivered to the address indicated by the Website / Online Store.
The consumer will be informed about the result of considering the complaint by the Online Store via e-mail.
If the complaint is considered positively and the Consumer does not use the option to replace the goods with a new one or another, the value of the order will be returned to his bank account within no more than 14 working days.
§4 Product return and replacement
Based on Article. 27 of the Act of 30 May 2014 on consumer rights, the consumer has the right to withdraw from the contract within 14 days from the date of delivery of the goods without giving any reason.
The buyer returning items is obliged to send to the Online Store an unequivocal statement of withdrawal from the contract containing: information on withdrawal from the contract with reference to the above-mentioned Act, order number, date of order, name, surname and address of the Consumer to the e-mail address: firstname.lastname@example.org and send the goods back by shipment with the note RETURN to the following address:

Items returned by the Consumer should be undamaged, with tags and seals intact. The hygiene stickers should also be intact. The product must be in its original packaging.
Withdrawal from the contract under the terms of §4 point 1 of the Regulations, the Seller and the Buyer are obliged to return everything received from the other party in accordance with the Agreement.
The costs of returning the goods are borne by the Consumer.
In the event of withdrawal from the contract, the Online Store will return all payments to the Consumer no later than 14 working days from the receipt of the returned items. Refunds will be made using the same payment methods that were used by the Consumer in the original transaction, unless the Consumer expressly agrees to a different solution.
The consumer, with the consent of the Online Store, may, within 14 days from the date of receipt of the goods, exchange it for another. In this case, the Buyer should contact the Online Store via the e-mail address: email@example.com.
The right to withdraw from the contract is not entitled to the Consumer in the case of:
for the delivery of a non-prefabricated Product, manufactured according to the consumer's specifications or serving to satisfy his individual needs
Orders of non-standard products at the client's individual request (technical changes, non-standard dimensions)
Damage to the product or if it shows visible signs of use by the Consumer, despite not removing string seals, labels and hygiene stickers.
§5 Protection of personal data
Providing personal data by the Buyer is voluntary, but their absence prevents the order from being processed. By making a purchase, the Buyer agrees to the collection, processing and use of personal data by the / Online Store for the purpose and scope necessary to complete the order by the Online Store (ie delivery of the goods to the Buyer and settlement of payments).

The data is processed with the taking into account the security requirements specified in the Act of August 29, 1997 on the Protection of Personal Data (Journal of Laws of 2002, No. 101, item 926, as amended) and other statutes based on it.
The buyer has the right to access, change, request the cessation of personal data processing or delete personal data from the database. This should be reported by e-mail: firstname.lastname@example.org
The buyer may or may not agree to receive the e-mail newsletter.
§6 Final provisions
Any disputes between the Consumer and the Online Store are settled amicably pursuant to Art. 1831 and the code of civil procedure.
The law applicable to the assessment of the legal relationship created on the basis of these Regulations is Polish law.
In matters not covered by these Regulations, the provisions of the Civil Code and other laws shall apply.
